The MBBA-NH provides a medium for input to the New Hampshire Banking Department and New Hampshire Legislature on regulatory policies and legislation. The MBBA-NH is a liaison with the Mortgage Bankers Association which works with Congress and Federal regulatory authorities to protect the vital interests of the mortgage industry.  MBBA-NH works with the lobbying firm, Demers,Prasol & Thomas, Inc. to be sure our needs and concerns are being heard by New Hampshire Legislators.  Click on the links below for more information:

  • Trigger Lead legislation SB 332 - pending at his time.

  • Remote Online Notarization Law- (2-year process) MBBA-NH team drafted the legislation to adapt to NH law, organized and educated our stakeholders, testified at all public hearings.
  • MLO Remote Work - NH Banking Department "Clarifies" their position on 397-A:1, IV(b)

  • FHA/HUD - Single Family loan limits increased in Hillsborough and Merrimack Counties - Notified the Governor of the issue, helped draft a letter of request the Govenor signed and submitted to FHA and HUD.  

  • Transitional Licensing SB 81 - Law, Signed by the Governor 
  • SB 306 Report - Committee member to study NH Foreclosure law, new Federal Regulations, and Fair Foreclosure practices 

  • SAFE ACT Modifications - (2-year battle) HB 247 added exemption to licensure for person who negotiate no more than 3 residential loans in a calendar year.  HB 408 Clarified an exemption from licensing requirements for attorneys who provide legal services in connection to with residential mortgage loans. 
  • Mortgage Foreclosure Legislation - HB 1252 and HB 1363 were both reactions to consumer complaints about the MERS system.  HB 1252 (Defeated) would have required coping of the deed of a property to be foreclosed and signature of the clerk before a foreclosure sale can take place.  HB 1363 (Defeated) would have defined a recorded interest relative to mortgage foreclosures. 
  • HB 594 Mortgage Bankers, Brokers and Originators, General Consumer Credit Laws - Advocated to exclude language that would have prohibited yield spread premiums.
